NYS Family Court Order of Protection in New York
If you're living in New York state and you are being abused or threatened with violence domestically, you can file an order of protection. The order of protection commands the abuser to stay away from you. You can use such an order against a spouse or former spouse; someone whom you have a child with; or anyone related to you by blood kinship or through marriage.
Many people mistakenly believe that there's little they can do against domestic abuse or violence, but that's not true. An family court order of protection is legally binding upon the perpetrator of the violence or abuse, and if they violate it they will be punished severely by the courts of New York.
Does this absolutely guaranteed your safety? Of course not, for nothing does. But if the perpetrator does violate the NYS family court order of protection, they can be arrested, tried, found guilty, and subsequently thrown in jail. In addition, if they are found to be in violation of the court order, you can petition the court to extend the time for which the court order of protection remains in effect.
Since a NYS family court order of protection does not completely guarantee anyone's safety, there are further steps you can take to protect yourself if you are being threatened with domestic violence.
